Understanding Prenuptial and Postnuptial Agreements

A prenuptial agreement — also known as a premarital or antenuptial agreement — is basically a contract that is signed between two parties before they get married. A validly drafted prenuptial agreement can override standard legal provisions and govern issues such as:

  • Each party's rights to certain assets and types of income
  • Each party's responsibilities for the other party's debts
  • The spousal support, if any, that one party has to pay in case of divorce

A postnuptial agreement is basically the same thing as a prenuptial agreement, but it is adopted after the parties have gotten married. Properly drafted postnuptial agreements are also valid in California unless there is evidence of duress.
