Understanding People's Reasons for Legal Separation
Legal separation in California is virtually identical to divorce. The same issues are settled under the same legal standards. The only difference is that at the end of the process, the spouses are still legally considered to be married and therefore may not marry anyone else.
Like divorce, legal separation allows a married couple to disentangle their assets and formalize their child custody and support arrangements so they can live apart and move on with their lives. People generally choose separation over divorce for one of two reasons.
- Religious grounds: Some people are opposed to divorce — and especially the possibility of remarriage — as a matter of religious faith. Many religions that do not approve of divorce have no objections to legal separation.
- Health insurance: In some cases, both parties will agree to legal separation so that one spouse can remain covered by the other's insurance. This is common in cases where one spouse would not be able to buy insurance due to a preexisting medical condition.
In order for a separation case to move forward, both parties must agree to separation rather than divorce. If either party wants a divorce at any stage in the proceedings, the separation case is automatically converted into a divorce case.
