Understanding How the Courts Handle High-Income Parents
In California, there is a special approach that the courts can take to child support when one of a child's parents has particularly high income, generally more than $1 million per year.
In these situations, parents can argue that because they are capable of providing everything their children need, child support should not be rigidly calculated based on their income.
The courts do not have to approve alternative child support arrangements for high earners. This approach is entirely optional, based on the best interests of the child.
For instance, if the result of the arrangement is that the child will have a much more affluent lifestyle while staying with one parent than with the other, the court may consider this to be damaging to the parent-child relationship and may require use of the child support formula.
